General Terms and Conditions Pertaining to the Haufe Academy Coaching Platform

These General Terms and Conditions (hereinafter “GTC”) of Haufe Service Center GmbH apply to the processing of coaching services on the Haufe Academy Coaching Platform. We provide our services exclusively on the basis of these GTC; we do not acknowledge any terms and conditions that conflict with or deviate from these GTC except we have expressly agreed to their validity in writing.

1. Your Registration

Please register online via our website using the registration forms prepared for you. Your registration is binding. We will then send you access credentials to your personal Coaching Portal. The prices shown on the website on the booking date apply. The invoice is due immediately after transmission without any deductions.

2. Your Coaching

After you have decided to work with a coach, you shall arrange the coaching appointments with your coach on an individual basis. All coaching sessions shall take place virtually on video conferencing platforms or other online collaboration platforms provided by you. We do not assume any warranty for the functionality and availability of the technical platforms provided. For this purpose, you must provide the respective coach with any necessary access data in good time before the commencement of the coaching session, as well as any other requirements for access.

If the coaching cannot be carried out due to technical problems on your end, the scheduled session will be charged. If technical problems on the part of the coach occur that affect the implementation of the session, the scheduled session will be rescheduled to a later date.

If both parties wish to conduct the coaching in the form of a physical meeting, you may coordinate this individually with your coach. In this case, travel costs for the coach will not be covered by us.

Recording of virtual coaching sessions is not permitted without our prior consent.

3. Validity of Coaching Packages

You may call up the individual coaching units at any time from the time you order for a period of 12 months.

4. Representation

Whilst it is possible at any time to transfer open units once to another person free of charge. Should a unit within a coaching package be transferred more than once to another person, we charge a transfer fee of € 100 plus VAT per transfer.

5. Rescheduling of Individual Appointments

No fees are charged for rescheduling individual coaching sessions, provided the rescheduling is made 24 hours before the appointment. In case of rescheduling less than 24 hours before the agreed appointment, the session will be charged as if it had taken place. The rebooking is made directly with the coach in text form.

6. Cancellation

Coaching packages for which you have not yet received any coach proposals from us may be cancelled at any time in text form. Coaching packages that have already been commenced may also be cancelled at any time in text form. All coaching units completed to date will be invoiced.

7. Instructions on Withdrawal for Consumers

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract. To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.  To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

8. Confidentiality

The relationship of trust between all parties involved requires strict confidentiality. We therefore undertake to keep confidential and/or proprietary all information, data, or documents belonging to you, whether written or oral, and including but not limited to ideas, concepts, methods, etc. ("Confidential Information"). ("Confidential Information"). In particular we agree not to sell, trade, publish, reproduce or otherwise disclose any such Confidential Information to any person or entity without first obtaining your written consent.

The above obligations, shall not apply to information which:

  • are already in the public's possession or become available to the public through channels other than an act or omission by us;
  • must be published according to law, official order or court decision
  • provided that the User and the Company are informed thereof without undue delay.

The obligation to maintain confidentiality also applies after the termination of the coaching sessions. Cases in which legal obligations exist with regard to the exchange of information, or in which we are explicitly released from the confidentiality obligation by you, are excluded from this regulation.

Once the purpose for which the Confidential Information was acquired has been achieved, we will promptly return or destroy all originals and copies of the Confidential Information.

9. Cancellation of Appointments, Modification of Agreed Coaching Sessions

We reserve the right to postpone previously agreed coaching sessions before the scheduled date for material reasons beyond our control (e.g. sudden illness of the coach, force majeure). Furthermore, we are entitled to replace the scheduled coaches in such cases with other persons equally qualified with regard to the announced topic. You will receive three new coach proposals to choose from free of charge.

10. Liability

The documents provided in the context of the coaching sessions are prepared to the best of our knowledge and belief. Liability and warranty for the accuracy, topicality, completeness and quality of the contents is expressly excluded.

11. Final Provisions

The place of performance and exclusive place of jurisdiction for disputes relating to merchants, legal entities under public law or special funds under public law arising from contracts is Freiburg im Breisgau.

This Agreement is made in German and English. In the event of a dispute as to the terms of this Agreement the German version shall prevail.

We do not participate in dispute resolution proceedings before a consumer arbitration board. The European Commission provides a platform for out-of-court online dispute resolution (so-called ODR platform) under https://ec.europa.eu/consumers/odr/.
