General Terms and Conditions of Business for the Competence Programme for Specialist and Managerial Personnel
Please register online via our website or in writing using the registration forms that have been prepared for you. If you are not using the shopping cart on our website or our prepared forms, please be sure to state the name of the participant and the full company address/invoice address together with telephone & fax numbers and e-mail address. Your registration is binding; registrations are booked by us in the order in which we receive them. Should the course be full, we will contact you immediately. Otherwise we will send you a confirmation of your registration.
Course fees are generally invoiced shortly after the beginning of the course and are payable immediately. Fees for e-learning offers are invoiced immediately upon registering for the course. The prices stated in our online shop on the booking date apply.
The various discounts offered cannot be combined. This also applies to total prices that are already discounted. You are always given the discount that is the most favourable for you.
Should your organisation have increased further training requirements, we can offer you individual terms in relation to annual turnover. For further information on our service for major customers, please call us on 0761 595339-05.

Your course cancellation guarantee
You may nominate a substitute at any time to replace the registered participant. You will not incur any additional costs.
Changes to booking
You may change your booking to a different course date or even change the course at any time. Please notify us of changes in writing. In the event of a change of booking (which is only permitted once), we charge the following administrative fees:
· Change of booking up to 4 weeks before commencement of course: no charge
· Change of booking less than 4 weeks before commencement of course: € 150.00 plus VAT (€ 178.50 incl. VAT); for conferences: € 30.00 plus VAT. (€ 35.70 incl. VAT)
· Booking changes for e-learning courses and e-examination dates are free of charge.
You may cancel your contract at any time. However, this can only be done in writing. Text form is sufficient. Please note that the following administrative fees will be charged:
· Cancellation 4 weeks or more before commencement of course: € 150.00 plus VAT (€ 178.50 incl. VAT).
· Cancellation less than 4 weeks before commencement of course: full course fee plus VAT.
This also applies in the event that the registered participant fails to attend.
Please note that special conditions apply to the course ‚Dialectic and Rhetoric‘.
If you need to cancel, please also remember to cancel your hotel booking.
In the case of e-learning courses, cancellation is free of charge before the first login. Once you log in to the course for the first time, we charge the full course fee plus VAT.
In the case of transfer coaching, cancellation is free of charge as long as no dates have been arranged with the trainer. If cancelling after dates have been arranged, we charge the full course fee plus VAT.
We reserve the right to cancel a course on grounds of insufficient demand or low participant numbers (up to ten days before the planned course date) or for any other important reasons for which we are not responsible (e.g. sudden illness of trainer, Act of God). Any course fees you have already paid will of course be reimbursed. Any further liability or compensation claims which do not concern injury to life, body or health are excluded, except in cases of intent or gross negligence on our part. Please also take this into account for any hotels and flight/train tickets you may have booked.
Right to make amendments
We are entitled to make any necessary changes or departures to the content, methodology or organisation of a course (e.g. as a result of legal changes) before or during a course, insofar as this does not significantly affect the usefulness of the advertised course for the participant. We are entitled to replace the proposed trainers where necessary (e.g. in the event of illness or accident) with other persons who have similar qualifications in the respective field.
Documents provided throughout a further training activity are compiled to the best of the compiler’s knowledge. We assume no liability or warranty for the accuracy, currency, completeness or quality of the content.
Reservation of title and usage of teaching materials
We reserve unrestricted title to all deliveries of teaching materials up until complete fulfilment of all payment obligations by the customer. The resale or circulation of teaching materials to or among those who are not colleagues or employees of the customer is not permitted. In particular the publishing of audio and video files, digital presentations or manuscripts on publicly accessible internet portals (sharing) is prohibited.
Photo and video recordings
At some events, participants may be photographed or recorded on video. Please note that these images and recordings may be used for advertising purposes by Haufe Akademie GmbH & Co. KG.
If recordings are to be use for marketing purposes then we will contact you for your approval before the event begins.
Rules relating to participants of distance-learning courses
The place of jurisdiction is the place of residence of the participant.
The fee for a distance-learning course can also be paid in several regular and equal instalments. The precise amounts are stated in the offer. The invoice for the first instalment is due upon commencement of the course.
Conditions of termination:
The distance learning contract may be terminated by either organiser or participant on important grounds at any time. The contract is concluded on the day on which it is signed.
Right of revocation; revocation instructions:
You are entitled to cancel this contract within fourteen days, without stating reasons. The deadline period of fourteen days begins with the day on which the first teaching materials are received either by you or by a third party authorised by you, who is not the transporter. To exercise your right of revocation, you must inform us in an unambiguous declaration (e.g. a letter sent by post, a fax, or an e-mail) of your decision to revoke this contract. You may use the model revocation form for this purpose, which you will find in your learning environment. This is, however, not mandatory. To comply with the revocation deadline, it is sufficient that the notification that you are exercising your right of revocation is sent before the deadline expires. The revocation should be sent to: Haufe Akademie GmbH & Co. KG, Customer Service, Munzinger Strasse 9, 79111 Freiburg, email@example.com.
Consequences of revocation
If you revoke this contract, we are to return all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from you having selected a method of delivery other than the cheapest, standard delivery offered by us) immediately and at the latest within fourteen days from the day on which we received your notification of revocation of this contract. We will use the same means of payment for this return payment that you employed in the original transaction unless a different arrangement has been expressly agreed with you. In no event will you be charged any fees for this return payment. We may refuse to render this return payment until we have received the goods back or until you furnish proof that you have sent the goods back, whichever is the earlier. You are to send back or hand over to us the goods immediately and in all cases within fourteen days from the day on which you notified us of the revocation of this contract. The deadline is deemed adhered to if you send the goods before expiry of the fourteen-day deadline. You are to cover the immediate costs of the return shipment of the goods.

Data processing in the context of coach matching
(1) Within the context of matching a Coachee with a suitable Coach, Haufe Service Center GmbH avails itself of the services of a data processor, Haufe Advisory GmbH. The latter conducts the matching of Coachee and Coach on behalf of Haufe Service Center GmbH, and by so doing, personal data is processed. This data is essential for performing a successful match and thus for rendering the contractual services. The data processing is necessary for implementation of the service agreement.
(2) Insofar as special categories of personal data of the Coachee in the sense of Article 9 Paragraph 1 of the EU General Data Protection Regulation are processed in the context of coach matching, these are necessary for rendering the contractual service. To process this data, Haufe Service Center GmbH obtains the consent of the Coachee through the data processor, Haufe Advisory GmbH. If the Coachee refuses to give his consent, contractual services can either not be performed or not performed as agreed.
Use of e-learning offers
Every participant receives from us a personal login for accessing e-learning software. Use of the software is restricted to this particular participant and is available for a certain period only. It is not permitted to disclose the login data to any third person.
Special conditions regarding the use of eAcademy
Use of the services offered at www.eacademy.haufe.de is additionally subject to the following special provisions.
eAcademy offers digital learning services to companies and their employees on a variety of subjects, aimed exclusively at people in business. eAcademy’s services include high-quality videos produced by technical experts and application modules, such as checklists, implementation tips and instructions made available for download in PDF format. eAcademy can also support you with any individual projects you may have. You can also arrange for a telephone coach to be assigned to you to support your project work as a 1:1 sparring partner.
Registration / Access
Prior to booking an eAcademy course, potential users can view a demo of the eAcademy’s courses free of charge and without registration, by clicking on „View demo“. This demo does not provide full access to all the services available with an eAcademy course, but it does give an overview of the individual course components.
To use eAcademy, users have to go through a booking process in which they register, create an account and provide their data. Every user receives a personal login with which they can access eAcademy when booking an eAcademy course. It is not permitted to disclose this login data to a third party.
The user may also optionally book an individual coaching package during the ordering process.
By clicking on the „Book now“ button, you are making a binding booking for a course or coaching package. You will then receive a booking confirmation by e-mail.
We are entitled to block your access to eAcademy without stating reasons if you do not use the offered services for a period of 3 years. The user will be informed by e-mail 4 weeks in advance of the impending deactivation of the login.
All users are entitled to delete their eAcademy account at any time and without stating reasons. Deletion of an account does not release a user from his payment obligations.
Your data is always processed in compliance with statutory provisions. For additional information concerning data protection in relation to the services offered by eAcademy, see our data protection declaration, available at: https://eacademy.haufe.de/datenschutz
We expressly reserve the right to change, supplement or delete parts or all of the content of individual eAcademy courses and the eAcademy platform without prior notice, or to temporarily or permanently discontinue the provision. In the event of a final decision to discontinue a course, the user will be notified in advance by e-mail, subject to a period of notice of 4 weeks.
Users can optionally book an eAcademy course together with an individual online coaching package. A coaching package to accompany an eAcademy course can also be booked at a later date.
Each online coaching package booked comprises a total of 3 hours, which can be divided into between three and six individual coaching sessions.
Once a coaching package has been bindingly booked, the user can arrange an individual coaching session, by selecting a date suggested by eAcademy.
Once the date has been confirmed by e-mail, the user will be contacted by the coach either by telephone using the number provided or by e-mail.
Once arranged, the time of the coaching session is binding and cannot be cancelled or rebooked by the user. If the user is unable to participate in a coaching session that has already been booked and confirmed, this coaching unit will expire unused.
It is not permitted for another user to attend the booked coaching session in place of the registered user.
The user can request an individual coaching date at any time within a period of 12 months from the date on which it was booked, subject to the availability of the coach, on the basis of the suggested dates.
We reserve the right to postpone any arranged coaching units before their planned date in the event of important reasons that are beyond our control (e.g. sudden illness of the coach or force majeure) or to replace a scheduled coach with another person who is equally qualified for the subject in question.
Prices and Payment
Unless otherwise stated, all prices quoted are exclusive of VAT. Prices quoted on the eAcademy website are non-binding. The prices stated in the booking confirmation shall apply. Course fees will be invoiced immediately after booking and are payable immediately. Invoices are generally forwarded by e-mail.
The relationship of trust between all parties necessitates strict confidentiality. We therefore undertake to keep confidential and/or proprietary all information, data or documents belonging to the user or the associated company, whether written or oral, and including but not limited to ideas, concepts, methods, etc., and to keep such information, data, or documents confidential and/or proprietary („Confidential Information“). In particular, we undertake not to sell, trade, publish, reproduce or otherwise disclose such Confidential Information to any person or organisation without the prior written consent of the User and the organisation.
The above obligations are not applicable to information which:
– is already in the possession of the public or will become accessible to the public through channels other than an act or omission by us;
– must be published in compliance with the law, an official order or a judicial decision – provided that the user and the company are informed of this immediately.
The obligation to maintain confidentiality applies even after performance of the coaching sessions has terminated. Cases in which there are legal obligations with regard to the exchange of information or in which we are explicitly released by the user or the company from their obligation of confidentiality are excluded from this provision.
Once the purpose for which the Confidential Information was acquired has been achieved, we will immediately return or destroy all originals and copies of the Confidential Information.
We strive to provide permanent access to eAcademy (365 days, 24 hours). However, we are unable to expressly guarantee its availability at all times. Access may be temporarily restricted for technical reasons, such as for necessary maintenance or repair activities.
Please note that dates from April 2021 onwards are preview dates. You may register for these dates now. However, for these dates, we reserve the right to revise the further training material and course duration, and where applicable, to make a price adjustment.
Services included with courses
Unless otherwise stated, the fees for classroom courses include the following,
· One joint lunch per full seminar day,
· Drinks during breaks
· Extensive course documentation.
We have reserved a limited quota of rooms up until four weeks before the date of the course. Please arrange your booking directly with the hotel.
Third party providers
Where services from third-party providers are presented, Haufe Akademie GmbH & Co. KG acts solely as a mediator of services. In the event of a booking, contracts with respect to the service provision are concluded solely between the customer and the respective third-party supplier/service performer. Special provisions and restrictions (general terms and conditions of the third-party supplier) may apply to the selected services. The entire handling of the contract and settlement of any disruptions to performance take place exclusively between the customer and the third-party supplier.
The Haufe Akademie GmbH & Co. KG website contains links to third-party websites. The Haufe Akademie provides these links as an additional service/courtesy. The Haufe Akademie has no influence over the content of linked third-party websites. Therefore, the Haufe Akademie is not liable for the accuracy, currency or completeness of the information given there. Furthermore, the Haufe Akademie expressly disassociates itself from the content of all linked pages. The Haufe Akademie accepts no warranty for the functionality and/or correctness of the pages or of the data, services or works offered there and is under no circumstances liable for damage or consequential damage or for any kind of loss caused directly or indirectly by operation, non-operation, use or utilisation in any form whatsoever. The Haufe Akademie hereby advises that contractual relationships with third-party suppliers are concluded solely in accordance with their terms and conditions of business.
We do not take part in dispute settlement proceedings before a consumer arbitration body. Contractual implementation (invoicing etc.) is performed by Haufe Service Center GmbH in its own name for the account of third parties (commission):
