  • Written form requirements, letting from the drawing board, supplementary issues, representation at the conclusion of the contract.
  • Effective inclusion of annexes to the rental agreement, remedies in the absence of written form.

Form rental agreements

  • including the transparency requirement and its consequences, general contract terms vs. individual agreements, surprising clauses, extension, supplement and amendment agreements.

Exclusions of liability and protection against competition

  • including warranty liability, delayed start of rental, product range restrictions.

Enforce rent adjustments with legal certainty

  • including the requirements of the Price Clause Act.

Operating costs

  • including preclusive periods for commercial leases, effective allocation of administrative costs.

Maintenance and repair costs

  • including effective passing on of costs to the tenant.

Defects in the rented property

  • including excessive heating of the leased property, construction noise from the neighboring property, lack of official permits, area calculations, choice of area scale (gif/DIN 272), special features when renting retail space, condition of the leased property upon return, tenant's duty to operate and transfer use.

Termination rights

  • including changes to the purpose of use, enforcement and formulation of special termination rights, termination agreements, withdrawal of use, subletting, disruption of profit/sales expectations, special termination rights.

Action for eviction and forced eviction

  • including debt collection, enforcement options against tenants and third parties, cost-effective "Berlin model", supply freeze.
