Legal basis for cooperation between employees and employers

 

German employment law is extremely complex: all attempts to combine the numerous individual laws such as the Works Constitution Act (BetrVG), Protection against Dismissal Act (KSchG) and Working Hours Act (AZG) into a uniform labor code have so far failed.

The reason: employment law contains all the rules that deal with the legal relationship between employer and employee - from drafting contracts and dealing with the works council to warnings and dismissals. The basis of this relationship is the employment contract, plus laws, regulations and court precedents regarding the health and safety of employees. Collective bargaining, union membership and labor disputes also play an important role for the legislator.

Therefore, in addition to individual employment law, which deals with the relationship between employer and employee, collective employment law is also important, especially for larger companies: these laws regulate the legal relationship between employer associations and employee associations. Like all laws, employment law is subject to constant change. Most recently, the introduction of the minimum wage and the reform of the Temporary Employment Act and Maternity Protection Act created a need for action in HR departments.

We provide essential basic knowledge for qualified HR work in the "Fundamentals of labor and works constitution law" course. You will find out which legal regulations apply to collective agreements and works agreements, what you should consider when hiring new employees, what role data protection plays and what you need to bear in mind when it comes to sickness, continued pay, parental leave and vacation planning.

In the "Employment and Works Constitution Act for Advanced Learners" course, we go into even more detail. Our renowned speakers will explain how to adapt employment contracts to changing conditions, how to avoid risks in the event of a transfer of business and change of business and which regulations apply to temporary work.

The training "News from recruitment to dismissal" provides information on changes to the legal situation: participants learn which provisions now apply to the General Equal Treatment Act (AGG), vacation law and company reintegration management.

If you would like to know more about drafting legally compliant contracts, you should attend the employment law training "From employment contracts to termination agreements". Our speakers will advise you on the conclusion, form and content of the employment contract as well as the formulation of transfer clauses, compensation for overtime and much more.
