This training is held in German.
Since 2023, the Supply Chain Due Diligence Act (LSKG) has applied to companies (regardless of legal form) with >3,000 employees in Germany. From 2024 for companies >1,000 employees. As smaller German companies will also be affected by the obligations of their major customers as part of the supply chain, they should also familiarize themselves with the new regulations at an early stage. In this seminar, you will learn what the new Supply Chain Act means for your company, what changes it entails and how you can implement them professionally and in compliance with the law.

Current information with Supply Chain Due Diligence Act (status: end of October 2024):

The German Chancellor has made recent political statements to repeal the German Supply Chain Due Diligence Act in the near future and replace it with a faithful national implementation of the EU Supply Chain Directive (CS3D). However, the LkSG is currently still a formally valid law. As soon as these political announcements have come into force or are concretely tangible, we will promptly adapt the content of the seminar. It therefore makes sense to keep abreast of current developments.

Risk management and risk analysis

  • Requirements for appropriate and effective risk management.
  • Carrying out a risk analysis for the company's entire business area and all direct suppliers.

Preventive measures

If corresponding risks are identified within a supply chain as part of the risk analysis, preventive measures must be taken. These can be, for example

  • Necessary changes to contractual arrangements with suppliers.
  • Expansion of a "Code of Conduct for Suppliers", in which the company sets out its binding expectations for cooperation with suppliers.
  • Obligation of the supplier to adhere to these compliance standards in the downstream supply chain as well.
  • Regular reviews of existing and future suppliers with regard to their ability to comply with due diligence obligations.
  • Introduction of control rights and implementation of regular and risk-based control measures.
  • Requesting proof from the supplier that training has been carried out.

Remedial measures

  • Necessary remedial measures in the event of suspected violation of the legal positions to be protected at direct suppliers.
  • Termination of the business relationship.

The obligations of the Supply Chain Due Diligence Act must be applied to large companies (more than 3,000 employees) from 01.01.2023, i.e. everything must be implemented and functioning from January 2023. This means that the companies concerned will only have a short amount of preparation time to carry out a risk analysis for all suppliers, review and, if necessary, adapt contracts, define prevention and control measures and adapt (existing) software or, if necessary, select and introduce new software.
