Since December 1, 2021, the use of cookies and tracking tools has been regulated much more strictly for website operators on the internet by the Telecommunications Telemedia Data Protection Act (TTDSG). There is still uncertainty as to which cookies may be used without the consent of visitors and for which consent is mandatory.
The TTDSG combines the regulations of the Telecommunications Act (TKG) and the Telemedia Act (TMG) and aligns them with the GDPR. It also implements the requirements of the e-Privacy Directive (Directive 2002/58/EC). At the same time, the TKG was modernized in order to reduce legal uncertainties in the application of data protection regulations. The TTDSG regulates all information that is collected when telemedia services are used.
It is essential for companies to familiarize themselves with the relevant changes and apply them in order to avoid penalties and act with legal certainty.
