The transfer of personal data to third countries is subject to strict legal requirements in order to ensure a high level of data protection. According to the GDPR, suitable protective measures must be taken, such as the use of standard data protection clauses agreed between the data exporter and the data importer.
The ECJ's "Schrems II" ruling has introduced additional obligations. In particular, this includes carrying out a Transfer Impact Assessment (TIA) to assess whether an adequate level of data protection is guaranteed in the destination country.
This training provides the requirements from case law and the specifications of the data protection supervisory authorities that must be observed for data transfers to third countries and for a TIA. Practical examples are used to show how a TIA can be effectively implemented and carried out.
