The use of cookies and tracking tools has been severely restricted for operators of websites on the internet since December 1, 2021 by the Telecommunications Telemedia Data Protection Act (TTDSG). There is still uncertainty regarding the question of which cookies may be used without the consent of website visitors and for which types of cookies consent is mandatory. The new Telecommunications Telemedia Data Protection Act combines the provisions of the Telecommunications Act (TKG) and the Telemedia Act (TMG) in line with the GDPR and implements the ePrivacy Directive (Directive 2002/58/EC). At the same time, the TKG was modernized. This reorganization aims to clarify legal uncertainties in the application of data protection provisions. The TTDSG regulates all information that is collected during the use of telemedia services.
In order to avoid penalties, it is essential for companies to familiarize themselves with the relevant changes and apply them.
