Garnishment of wages, garnishment of salary & salary assignment
A wage garnishment always begins with the service of the garnishment and transfer order. This also applies to the garnishment of wages. Employers thus become third-party debtors and must take action. They must fulfill their obligations accordingly. Up-to-date and well-founded specialist knowledge of wage garnishment and salary garnishment is essential for drawing up a third-party debtor declaration, determining the garnishable wage component and taking into account special regulations for maintenance garnishments.
When employees make installment purchases or take out loans, they often sign an assignment of salary in the contracts. As a rule, the employer does not become aware of the salary assignment, provided that the loan or installment payments are properly serviced. If this is not the case, the creditor will disclose the salary assignment to the employer. Provided there is an effective assignment, the employer is obliged to pay the new creditor from the time of notification in accordance with § 409 BGB.
