Salary garnishment: employer's procedure after receipt of garnishment order
Salary garnishments are subject to legal regulations and laws. These must be observed by the employer after receipt of a garnishment and transfer order (PfÜB). A PfÜB is an act of compulsory enforcement issued by the enforcement court. As a result, a claim of the debtor against a third-party debtor (here: employer) is accessed.
In the case of a salary garnishment, the garnishment of claims is carried out by serving the garnishment order. Service must be arranged by the creditor. Realization takes place by means of the transfer order. In general, both the attachment order and the transfer order are sent together to the third-party debtor. These two orders are referred to jointly as the attachment and transfer order (PfÜB). The attachment and transfer order must also be served on the debtor with regard to the garnishment of salary.
